Terms and Conditions 

Thank you for choosing Livie’s Bakes ‘n’ Jams by providing you with a luxury cake (or decadent desserts). This contract will contain the policies and notices pertaining to your event. By signing this contract or submitting a deposit, you are confirming that you understand and agree to this agreement.

 

Please be aware that you must book your cake (or desserts) at least two weeks in advance, if not you will have a late sign-on fee ($25-$50). If the client has not submitted either a non-refundable deposit or full payment for the custom cake order, at the initial due date on the invoice, the decorator isn't obligated to start/complete the order. Any further questions must be submitted via email. Orders made 48 hours before it is needed, will not be accepted. 

 

This is an outline agreement to prevent any misunderstandings or assumptions pertaining to your order. 

 

Payment and Deposit Terms: 

 

1. At the time of booking and finalizing the details of your cake, the client must pay in full for their order, or when the initial due date of the invoice. For any cancellations after the first deposit that occurs for any reason, a cancellation fee of $25 will be sent to the client. 

2. Pricing is based on the entire order. Therefore, a reduction in serving size may not proportionally reduce the price of the order. 

 

Delivery and Set Up Terms:

1.  Livie’s Bakes ‘n’ Jams will provide delivery service to a client that needs the luxury cake (or decadent desserts) transported to the venue. An additional fee starting at $30 will be added to the invoice for delivery. Free delivery within 5 miles. Delivery starts at $30 that extends over 5 miles, but within 10 miles. Delivery that is over 10 miles starts at $30, and an additional 65 cents per mile. A Livie’s Bakes ‘n’ Jams staff will handle the setup of the cake (or decadent desserts). 

 

Pick-Up Terms: ​

• If the client chooses to pick up the order, or the name of the person on the contract to pick up the cake on their behalf, they are welcomed. However, the risk of loss may increase if the order is in the client’s possession and they do not adhere to Livie’s Bakes ‘n’ Jams direct instructions on how to handle the cake. Please be advised that if the client picks up their order (or another person sent by the client were to pick up the order), they should:

• Place it on the floor of their vehicle, or the flat surface in their trunk with the air conditioning on prior to picking up. 

​

• Travel at a moderate speed to avoid sharp turns and the cake possibly collapsing. Avoid stacking objects on the cake.

​

• Avoid direct heat exposure and sunlight to prevent the cake from melting

​

• Livie’s Bakes ‘n’ Jams is not held responsible in the event of the order collapsing or being damaged if the client (or another person sent by the client were to pick up the order) does not secure or adhere to these instructions. 

​

• In the event that the client sends a 3rd party holder (friend, family, etc…) to pick up their order. They must sign the contract as well, and a photo of the order will be sent to the client. Livie’s Bakes ‘n’ Jams will not be held responsible for any damages that the 3rd party holder may cause if they do not follow the instructions given by the baker.

 

Designs and Colors: 

1. There are many factors that determine a replication of a design for a custom cake. The availability of supplies, specific colors, location of event, and time. At Livie’s Bakes ‘n’ Jams, we value our clients and take pride in the appearance of our cakes being unique. Moreover, we respect the original idea and design of another cake decorator. Livie’s Bakes ‘n’ Jams reserves the right to limit the level of replication of the cake design that is provided, but still just as elegant as any cake that we make.

• In the event that a client doesn’t book with Livie’s Bakes ‘n’ Jams, they (the client) are not permitted to use the design or illustration that the owner has created for another baker to reference. 

​

• Here at Livie’s Bakes ‘n’ Jams, we aim to exemplify Christ in everything that we do. In order to do that, we refrain from adding or creating inappropriate and disturbing images/designs to our cakes. This includes body parts, horrific images, degrading slurs/ slang, etc. Thank you for your understanding. We hope to still be able to make your special occasion cake.

• Last minute changes to a design will be an additional $75 per hour it takes to change the design. Clients can make design changes up to 4 days before the order is due. This does not include custom toppers that have already been ordered. 

 

Before You Smash or Eat: 

1. Here at Livie’s Bakes ‘n’ Jams, we want to put your needs and safety first. We highly recommend that you NEVER SMASH YOUR FACE  OR ANYONE ELSE’S FACE OR HANDS INTO ANY OF OUR CAKES. Sometimes we have cake dowels in the middle of the cake to secure the structure. Sadly, there have been many cases where people from other states who have smashed their face into other bakery cakes. So please don’t smash your face into any of our cakes, your safety is important to us. Remember to remove the dowel(s) and inedible decorations before you start to consume your luxury cake.

• If you or your guests have an allergy to any food that could risk a reaction, please let the owner know this. Livie’s Bakes ‘n’ Jams is not responsible for any allergic reactions that was not discussed in the order process. We do use a COCONUT AND TREE NUT spray to crumb coat all cakes. 

 

Climate Control For Your Cakes: 

1. If in the event that you pick up your cake (or a third party), or we deliver your cake. Please adhere to the strict instruction of the decorator (or owner). 

• Your cake or baked goods are sensitive to the temperature. Never leave your desserts or cake outside (or in a humid environment) without the proper climate control measures, like air conditioning. 

 

• Livie’s Bakes ‘n’ Jams is not responsible for the melting of the cake or baked goods if the client (or 3rd party members) doesn’t adhere to the instructions given to the client.
